Terms of Service

1. Agreement

These terms govern your use of getUGC (the “Service”), including our website and apps. By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you use the Service for a business, you confirm that you can bind that business to these terms.

2. Eligibility and accounts

  • You must be at least 18 years old.
  • The information you give us must be accurate, and you must keep it up to date.
  • You are responsible for your account and everything done with it. Keep your password safe.
  • Only connect social accounts that you own or are authorised to manage.

3. How the Service works

Brands publish campaigns with a brief and a budget. Creators apply, post content that follows the brief, and earn based on the performance of that content, within the limits set by the campaign. getUGC provides the platform. We are not a party to any arrangement between a brand and a creator, and we are not an employer or agent of either.

4. Creators

  • Follow each campaign brief and these terms.
  • Keep your connected accounts active so we can measure your content. If a connection breaks, we may not be able to count your results.
  • Keep campaign posts up. A post that's taken down may stop counting and not be paid.
  • Your content must be your own original work, and you must have every right and permission it needs, including from anyone who appears in it and for any music used.
  • Clearly disclose paid partnerships in every sponsored post, for example with #ad or the platform's paid partnership label, as required by law and platform rules.
  • Do not inflate results. Buying views, likes or followers, or using bots or engagement schemes, is prohibited.

5. Brands

  • Campaign briefs must be accurate, lawful, and must not ask creators to make false or misleading claims.
  • You must fund a campaign before it goes live, unless we agree otherwise. Campaigns are reviewed before they are published, and we may reject a campaign at our discretion.
  • Use creator information and insights only to run your campaigns on getUGC, and do not copy, export, sell or reuse them for any other purpose.
  • Review posts promptly. Posts you don't review in time are approved automatically and paid.

6. Payments

  • Amounts are in UAE dirhams (AED) unless stated otherwise.
  • Creator earnings are calculated from performance data received from the connected platforms, under the campaign terms shown when you apply. Each campaign has a budget, and posts stop earning once it's used up.
  • Earnings become available to pay out after a holding period. They may be held, reduced or withheld where content breaks the brief or these terms, is taken down, or where we reasonably suspect fraud or artificial engagement.
  • getUGC charges creators a service fee, deducted from each payout. The fee is shown before you confirm a payout.
  • Payouts are sent to the UAE bank account on your account, and a minimum payout applies. You are responsible for making sure the details are correct.
  • After a campaign ends and its posts are settled, a brand can request a refund of unspent budget.
  • You are responsible for any taxes that apply to amounts you pay or receive.

7. Content and licences

  • Creators keep ownership of their content.
  • Creators allow getUGC and the brand running the campaign to view, display and reference campaign content, and its performance data, within the Service for the purpose of running that campaign.
  • Any other use of a creator's content by a brand, such as in paid advertising, requires a separate agreement with the creator.
  • Brands allow getUGC to display their name, logo and campaign details within the Service.

8. Disputes between users

Brands may flag content that does not meet a brief, and creators may fix or appeal it through the Service. We provide these tools but do not guarantee any outcome between users.

9. Third-party platforms

The Service relies on TikTok, Instagram, YouTube and other third parties. You must follow their terms and community guidelines. We are not responsible for their services, and features may change or stop working if a platform changes or limits access. getUGC is not affiliated with or endorsed by any of these platforms.

10. Acceptable use

You must not:

  • Break any law or anyone else's rights.
  • Arrange or complete campaign deals outside getUGC to avoid the Service or its fees.
  • Access, scrape or interfere with the Service or other users' data without permission.
  • Impersonate anyone or misrepresent your identity, audience or results.
  • Post or send anything unlawful, hateful, harassing, sexually explicit, violent or otherwise objectionable, or abuse other users.

We have zero tolerance for objectionable content and abusive users. We review every campaign before it goes live. Report a campaign, a post or a user with Report in the app or at support@getugc.com. We act on reports within 24 hours, removing the content and suspending the account where it breaks these terms.

11. Deleting your account, suspension and termination

  • You can delete your account in Settings on the website or Account in the app, subject to the conditions below. If you can’t sign in, email us (see our Privacy Policy).
  • Creators: you can't delete your account while a payout is on its way. Earnings not yet paid out when you delete your account are given up; we show you the amount and ask you to confirm first. Pending applications are withdrawn, your posts stop earning, and open flags on them are closed.
  • Brands: you can delete your account once every live campaign has ended and settled, unspent budget has been released and every refund has been paid. Campaigns that never went live are deleted. Your business name and logo stay on past campaigns.
  • Your posts stay on the platforms where you published them.
  • Deleting an account doesn't cancel anything already owed, and you may not delete an account to avoid a flag, a ban or these terms.
  • We may suspend or close accounts, withhold earnings connected to a breach, or remove content if you break these terms or we reasonably suspect fraud.
  • Sections that by their nature should survive termination will do so.

12. Disclaimers and liability

The Service is provided “as is”. Performance data and earnings estimates come from third-party platforms and may be delayed or inaccurate. Estimates are not guarantees. To the extent permitted by law, getUGC is not liable for indirect or consequential losses, and our total liability to you is limited to the fees we received from you in the 12 months before the claim.

You agree to compensate getUGC for losses caused by your content, your campaigns or your breach of these terms.

13. Changes

We may update these terms. If changes are significant, we will let you know before they take effect. Continuing to use the Service after that means you accept the updated terms.

14. Governing law

These terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. The courts of Dubai have exclusive jurisdiction over any dispute.
